Topic description
This topic will:

  • introduce the principles, objectives, structure and machinery (including underlying policy) and compliance approaches available under legislation in various Australian jurisdictions

  • evaluate legislation including environmental and forward planning, environmental impact assessment, biodiversity protection, pollution and waste management

  • analyse judgments of tribunals and courts involving disputes under legislation in Australian and overseas jurisdictions

  • consider a range of regulatory approaches, including economic mechanisms/fiscal assistance, education, administrative compliance tools, civil and criminal enforcement
Educational aims
The aims of this topic are to expose students at an advanced level to:

  • the role of ecologically sustainable development (ESD) in Australian and overseas environmental and natural resources laws and related principles such as the precautionary and polluter pays principles
  • the essential legal concepts underlying the Australian legal system and its constitutional structure
  • the nature (basis attributes and qualities) of environmental and natural resources law in Australia
  • political and administrative responsibility for the implementation of environmental and natural resources law in Australia
Expected learning outcomes
As a consequence of studying this topic students will be able to:

  • explain the range and nature of environmental and natural resources laws in Australia and overseas
  • discuss the structure and objects of such laws
  • analyse the administrative factors impinging on their application
  • evaluate the policy factors determining the nature of such laws
  • discern the compliance and enforcement machinery under such laws
  • explain the outcomes of disputes involving such laws (judgements and other adjudications)
