Topic description
The study of selected topics in constitutional and administrative law using historical and comparative approaches including: de facto regimes (Fiji), de facto officers, discretion, restitution in public law, estoppel and public law, the res judicata doctrine and the slip rule.
Educational aims
The topic aims to assist students to:

  • know and understand principles of public law relating to de facto regimes (Fiji), de facto officers, discretion, restitution in public law, estoppel and public law, the res judicata doctrine and the slip rule
  • appreciate the historical context in which the principles arose
  • compare different jurisdictions on the same issues
Expected learning outcomes
On successful completion of the topic, students will be able to demonstrate knowledge and skills in:
