Topic description
This topic provides an analysis of the structure of Australian banking and finance regulation and the financial institution/customer relationship. It provides students with an understanding of the uses and legal requirements for negotiable instruments including cheques, bills of exchange and promissory notes. It explores customer finance and protection instruments from the legal aspect. The topic also discusses special issues such as electronic banking, legal enforcement and recovery of finance and international regulation.
Educational aims
The topic aims to:

  • develop students' commercial law understanding and provide them with knowledge of the regulatory systems existing in the Australian banking and finance industries
  • extend students' understanding of legal theory and practice by contemplating the financial institution/client relationship
  • develop students' skills in discussing complex and detailed case law and statutory interpretation
  • develop students' skills in problem solving in a legal environment
  • advance students' skills in independent study and research
  • develop an appreciation by students of the positions held by lawyers, clients, advisors, financiers and bankers
Expected learning outcomes
Students completing Banking and Finance Law will have the ability to:

  • describe the regulation of banking both in Australia and overseas
  • analyse the legal implications of the use of many financial instruments
  • carry out independent research in an advanced legal area
  • effectively convey their findings from research in an advanced legal area
  • apply their specialist knowledge on day to day banking issues like the use of cheques, the use of EFTPOS and other electronic banking products
