Topic description
Areas covered are:

  • the regulation of business in the interests of consumer protection under both Commonwealth and South Australian legislation, namely Parts IVA, V, and VA of the Trade Practices Act 1974 (Cth), and related sections in Part 10 of the Fair Trading Act 1987 (SA)
  • the concepts and principles inherent within such legislation
  • the key legal notions of product liability, unconscionability, and misleading and deceptive conduct
  • remedies for breaches of consumer protection law
  • the application of theoretical knowledge to practical situations

Educational aims
The topic will:

  • introduce students to the regulation of business in the interests of consumer protection under both Commonwealth and South Australian legislation, namely Parts IVA, V, and VA of the Trade Practices Act 1974 (Cth), and related sections in Part 10 of the Fair Trading Act 1987 (SA)
  • provide students with a sound working knowledge of the above legislation
  • provide students with the ability to understand, explain, and apply the legal notions of product liability, unconscionability, and misleading and deceptive conduct
Expected learning outcomes
Students who successfully complete this topic will be able to:

  • identify, explain, deconstruct, and critique the key concepts, including those of an ethical and philosophical nature, that underlie Parts IVA, V, and VA of the Trade Practices Act 1974 (Cth), and related sections in Part 10 of the Fair Trading Act 1987 (SA)
  • independently construct a research proposal of either theoretical or practical significance with respect to Parts IVA, V, and VA of the Trade Practices Act 1974 (Cth), and related sections in Part 10 of the Fair Trading Act 1987 (SA) and then implement that research project
  • recognise and compare practical situations that constitute potential breaches of Parts IVA, V, and VA of the Trade Practices Act 1974 (Cth), and related sections in Part 10 of the Fair Trading Act 1987 (SA)
  • Distinguish possible remedies for breaches of Parts IVA, V, and VA of the Trade Practices Act 1974 (Cth), and related sections in Part 10 of the Fair Trading Act 1987 (SA)
  • use theoretical knowledge to effectively construct and communicate possible resolutions of practical situations
