This topic is concerned with the range of rights conferred in relation to innovation and intellectual effort, and in particular with the laws and processes relating to confidential information, copyright, designs, patents, passing off, unfair trading and trade marks.

The topic aims to:

• provide an overview of the law relating to intellectual property, focussing in particular on the protection of confidentiality, copyright, moral rights, designs, inventions, business reputation and trade marks; and
• provide an understanding of the social and economic context in which the law operates
• offer opportunities for the development and practice of the skills of research and written communication

Upon successful completion of the topic, students will be able to demonstrate knowledge and skills in:

• applying the legal provisions that grant intellectual property rights to Australian creators and innovators
• applying the basic legal principles concerning the recognition, acquisition, interpretation and enforcement of intellectual property rights
• understanding the social and economic context in which intellectual property law operates in Australia and internationally
• distinguishing between and applying the various rationales proffered for the granting of property rights in the product of creative, innovative and intellectual effort
• contributing to scholarly debates on the balancing of the interests of intellectual property owners, creators, and the public
• critically appraising the intellectual property system
• clear written communication
• independent research
• correct scholarly practices in the areas of citation and referencing
