Topic description
The main focus of the topic is on the statutory schemes for work health and safety under the Work Health and Safety Act 2012 (SA). In that context the issues covered include: History of WHS law; Common Law Action; Duties of persons conducting a business or undertaking (PCBUs) Other health and safety duties; Regulations and Codes of Practice; Enforcement mechanisms
Educational aims
The aims of the topic are to:

  • expose students to the principles and processes inherent in the statutory and common law regimes governing work health and safety in South Australia;

  • assist students to develop the ability to work within these regimes to resolve legal issues likely to arise for potential clients;

  • introduce students to the societal and legal debates, both historical and current, that underpin the legal regulation of work health and safety and develop students’ capacities to consider them critically.
Expected learning outcomes
It is expected that on completion of this topic students will have:

  • developed a sound understanding and appreciation of the statutory and common law processes of work health and safety in South Australia

  • demonstrated the ability to analyse, evaluate and apply the relevant legislation (in advising potential clients on legal issues

  • demonstrated the ability to critically examine issues and debates as these relate to aspects of work, health and safety legislation (both present and past)
