Topic description
More working hours have been lost to industry through occupational injuries and diseases than through industrial action. As a result compensation for loss of health through occupational risks and hazards, and the accompanying rehabilitation, are important areas of legal activity. The main focus of the topic is on the statutory scheme of compensation and rehabilitation as it operates in South Australia under the Workers Rehabilitation and Compensation Act 1986 (SA).

  • Who pays compensation?
  • Who can claim compensation?
  • When or in what circumstances is compensation payable?
  • When is rehabilitation available and what does it involve?
  • What are the benefits payable to claimants?
Educational aims
The aim of this topic is to provide students with an understanding and appreciation of the workers' compensation scheme as it operates in South Australia under the Workers Rehabilitation and Compensation Act 1986 (SA).
Expected learning outcomes
It is expected that on completion of this topic students:

  • will have become familiar with the provisions of the Workers Rehabilitation and Compensation Act 1986 (SA) and be capable of addressing the following questions:
    • Who pays compensation?
    • Who can claim compensation?
    • When or in what circumstances is compensation payable?
    • When is rehabilitation available and what does it involve?
    • What are the benefits payable to claimants?
  • will have developed a sound understanding and appreciation of that legislation as evidenced by their ability to (i) analyse, evaluate and apply it (in advising potential clients on legal issues) and (ii) critically examine issues and debates surrounding recent reforms to that legislation
