Topic description
This topic will provide an introduction to animal law and familiarise students with the regulation of animal protection and use of animals in Australia. This includes: the status of animals under the law; animal protection in Australia; international standards; philosophical discussions surrounding 'animal welfare' and 'animal rights'; and current animal law issues. The topic will critically assess the law's role in providing protection to animals, identify areas where it has been inadequate in that regard and encourage reflection on how it might be reformed.
Educational aims
This topic aims to:

  • introduce students to the major issues and debates surrounding animals in Australia and ensure that these students develop a confident understanding of these issues
  • assist students to participate in considered debate on the issues surrounding animal law
  • encourage students to engage in critical reflection on the current law as it relates to animals
  • allow students to apply their knowledge and understanding of animal law issues to develop their own positions in relation to the protection and use of animals
Expected learning outcomes
It is expected that on completion of this topic students will be able to:

  • describe the status of animals under the law
  • demonstrate knowledge and understanding of the key issues and debates relating to the status of animals under the law
  • explain, differentiate, critique and apply the major philosophical debates relating to animals and the law
  • critique the law as it relates to animals
  • discuss options for reform of the law as it relates to animals
  • critically appraise the position of animals in a human society
  • enter into considered debate with their classmates on the position of animals in a human society
  • demonstrate their abilities with regard to legal scholarship including: critical thinking, legal reasoning, legal research and legal writing
