Topic description
In Introduction to Law and Justice, students will be introduced to legal terminology and concepts, the different global legal systems, legal change and reform, and ideas about the relationship between ‘law’ and ‘justice’.

This topic will also introduce students to the foundations of the Australian legal system:

  • The Australian Constitution

  • Aspects of the nature of and the relationship between the different institutions of government and the separation of powers, with particular emphasis on the nature of the judiciary and judicial independence

  • Concepts of (and exceptions to) parliamentary sovereignty, responsible government, federalism, and judicial review

  • State constitutions and constitutional systems.
Educational aims
This topic aims to:

  • Introduce foundational legal terminology and concepts, the different global legal systems (common law, continental civil law, Indigenous, religious, international and regional), the relationship between ‘law’ and ‘justice,’ and ideas of legal change and reform

  • Introduce students to the Australian Constitution and the nature and operation of the legislature, executive and judiciary; introduce some aspects of the relationship between the different institutions of government and the separation of powers; introduce the State constitutions and constitutional systems.
Expected learning outcomes
On completion of this topic, students will be expected to be able to:

  1. Describe foundational legal terminology, concepts, and ideas, the different global legal systems, the relationship between ‘law’ and ‘justice’, and concepts of legal change and reform

  2. Identify the main features of the Australian Constitution and the operation of the legislature, executive and judiciary; some aspects of the relationship between the different institutions of government and the separation of powers

  3. Describe, and evaluate the significance to the Australian legal and constitutional system of, the concepts of parliamentary sovereignty, responsible government, federalism, separation of powers, and judicial independence (including the exceptions to those concepts)

  4. Identify the main features of State constitutional law

  5. Communicate effectively and appropriately

  6. Apply the appropriate legal conventions in their writing, including proper citation method.
