Topic description

Students will learn how to conduct legal research, analyse cases and interpret legislation, solve legal problems, interview and represent clients, and write and reference legal documents.

Legal Research: students will learn how to research and locate primary and secondary materials.

Legal Writing: students will learn to apply accepted English grammar conventions and the conventions of legal writing. They will learn to observe a legal style guide and referencing guide, plan, draft and finalise a response to a legal question.

Legal Analysis and Problem Solving: students will learn how to identify and interpret legal issues, and how to use primary and secondary sources to critically analyse legal issues and to determine potential solutions.

Client Representation and Interviewing: students will learn how to interview a client to identify key legal issues and provide preliminary advice. They will also learn how to persuasively represent their client in a legal negotiation.

Educational aims

This topic aims to:

  • Introduce students to legal research skills, including selecting, locating, using and updating appropriate primary and secondary sources
  • Introduce students to legal problem solving and analysis skills and allow students to develop and refine these skills
  • Provide opportunities for critical thinking and legal problem solving
  • Assist students in developing their oral and written communication skills
  • Allow students to develop client-oriented skills including interviewing, representation and negotiation skills
  • Help students to understand and follow the ethics of writing and conventions of legal writing
  • Introduce students to the conventions of academic integrity and ensure they can correctly apply these
Expected learning outcomes
On completion of this topic you will be expected to be able to:

  1. Identify, explain and analyse legal issues relevant to a legal problem
  2. Outline and follow an appropriate research process to solve a legal problem, utilising both primary and secondary sources
  3. Plan, draft, write and edit a legal document, correctly using the conventions of English grammar, spelling, phrasing and legal writing
  4. Explain the critical importance of proper acknowledgement of the sources of ideas and information and correctly use legal academic conventions related to citation and referencing the work of others
  5. Communicate in ways that are effective, appropriate and persuasive for legal and non-legal audiences
  6. Conduct client-oriented skills, such as a client interview and negotiation
