Topic description

This topic provides students with the skills required of an entry level lawyer in conducting civil litigation in first instance matters in courts of general jurisdiction, in a timely and cost-effective manner.

Competence in these skills is required for admission as a legal practitioner.

Educational aims

This topic aims to enable student to achieve competence, to the standard required by the admitting authorities, in conducting civil litigation in first instance matters in courts of general jurisdiction, in a timely and cost-effective manner.

Expected learning outcomes
On completion of this topic you will be expected to be able to:

  1. Demonstrate the competence required of an entry level legal practitioner in assessing the merits of a case and identifying the dispute resolution alternatives
  2. Demonstrate the competence required of an entry level legal practitioner in advising on costs of litigation
  3. Demonstrate the competence required of an entry level legal practitioner in initiating and responding to claims
  4. Demonstrate the competence required of an entry level legal practitioner in taking and responding to interlocutory and default proceedings
  5. Demonstrate the competence required of an entry level legal practitioner in gathering and presenting evidence
  6. Demonstrate the competence required of an entry level legal practitioner in negotiating settlements
  7. Demonstrate the competence required of an entry level legal practitioner in taking action to enforce orders and settlement agreements
