Topic description

This topic builds on exposure to ethical considerations in other topics and provides an overview of the regulatory framework for the legal profession, including a focus on lawyers' professional responsibility obligations. This topic also enables students to explore their identity as emerging legally literate professionals.

Educational aims

This topic aims to:

  • Provide students with knowledge and skills to respond appropriately to ethical issues
  • Provide students with an understanding of the regulation of the legal profession in Australia
  • Enhance students' understanding of legal practitioners' duties to the law, the court, clients and other third parties
  • Provide students with the skills to effectively reflect on their emerging professional identities
Expected learning outcomes
On completion of this topic you will be expected to be able to:

  1. Appraise the importance of regulation of the legal profession, the ethical obligations of legal professionals and professional wellbeing and resilience in the broader context of legal services delivery
  2. Discuss appropriate approaches to ethical decision making and respond to ethical issues likely to arise in professional contexts while exercising professional judgment as they recognise and reflect upon the professional responsibilities of lawyers in promoting justice and in service to the community in the context of being a legal professional
  3. Critique complex legal issues through legal reasoning and research to generate appropriate jurisprudential and practical responses to legal issues in the context of being a legal professional
  4. Combine sophisticated cognitive and creative skills with critical analysis when approaching legal issues and make reasoned and appropriate choices amongst alternatives in the context of being a legal professional
  5. Justify and interpret theoretical propositions, legal methodologies, conclusions and professional decisions in addition to identifying, researching, evaluating and synthesising relevant factual, legal and policy issues in the context of being a legal professional using intellectual and practical skills
  6. Discuss legal issues in effective, appropriate, and persuasive ways for legal and non-legal audiences using various communication methods while working both collaboratively and with a high level of autonomy, accountability and professionalism
